We respect the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you utilise our mobile application, MyFast Track (the “Application”).  Please read this Privacy Policy carefully.  IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION. 

 

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy.  You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.  

 

This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application or make payments, which may also collect and use data about you.  We are not responsible for any of the data collected by any such third party.

COLLECTION OF YOUR INFORMATION

We may collect information about you in a variety of ways.  The information we may collect via the Application includes:  

 

Personal Data 

The Application collects limited personal data in order to function. Access to the local device health store is requested and basic health information is read (Age, weight, biological gender). An entry is made to the health store so as to track the timing of each meal. This information along with meal entries are used to determine the start and finish time of fast. By default, it is limited to using entries created by the Application at the user’s discretion it can utilise meal data entered by third party applications.

 

The Application does not send this data anywhere, all personal data remains on your device.

 

Derived Data  

The Application uses timing between meals in the device health store to determine fasting periods.

 

Facebook Permissions  

The Application does not connect to or use Facebook in anyway.

 

Data from Social Networks  

The Application does not use social networks.

 

Geo-Location Information 

The Application does use or monitor your geo-location information.

 

Mobile Device Access 

The Application will request access to the local health store on your device. You can choose not to allow this however the app will serve no useful function without this access. If you do not want The Application to access your meal timing information from the health store we recommend you uninstall or do not use the app.

 

Mobile Device Data 

The Application does not require, access or use device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number.

 

We may request region information from the operating system to assist with formatting data appropriately (ie dates) for presentation to the user.

 

Push Notifications 

The Application will request permission to use local notifications to update the user on the status of their fasting. These notifications may be controlled from the device app settings. If you wish to opt-out from receiving these types of communications, it will not unduly affect the operation of the app.

 

Third-Party Data 

The Application does not share or seek information from third parties.

 

Data From Contests, Giveaways, and Surveys 

The Application does not currently partake in Contests or Giveaways. You may be asked to rate the app in the App Store.

USE OF YOUR INFORMATION

Having access to the local device health store allows The Application to provide personalised tracking of fasting for individuals.

 

Specifically, we may use information collected about you via the app and local device health store to: 

 

  1. Enter a meal time. 

  2. Forecast or notify when a user enters a fasting state (user defined threshold parameter).

  3. Forecast or notify when a user completes a fast (user defined threshold parameter).

DISCLOSURE OF YOUR INFORMATION

We may share information we have collected about you in certain situations. Your information may be disclosed as follows: 

 

By Law or to Protect Rights 

If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.

 

Third-Party Service Providers 

We will not share your information with third parties.

 

Marketing Communications

We will not use your information for marketing purposes.

 

Sale or Bankruptcy 

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity your personal data will not be affected as it remains on your device.  If we go out of business or enter bankruptcy the Application may be acquired by a third party. You acknowledge that such transfers may occur, and that the transferee may decline to honour commitments we made in this Privacy Policy. 

SECURITY OF YOUR INFORMATION

As any personal information we utilise is stored on your personal device, the greatest risk to your privacy is the physical security of your device. We encourage you to remain attentive to the physical security of your device.

 

Within your device we have utilised features of the operating system to isolate and protect your information. Specifically, the Application uses the sharing and privacy features provided by Health App. Users are advised to familiarise themselves with the sharing and privacy functions of the Health App to understand how information is shared and protected.

POLICY FOR CHILDREN

We do not knowingly solicit information from or market to children under the age of 13. If you become aware of any data we have collected from children under age 13, please contact us using the contact information provided below. 

OPTIONS REGARDING YOUR INFORMATION

Personal Information on your Device

You may examine personal information stored on your device at any time by examining the data in the “Meal Record” tab.

 

You may delete individual data elements via the “Meal Record” tab. Alternatively you may delete all your personal information by deleting the app and selecting the system provided options to delete local app information and data stored in Health App.

 

Emails and Communications

Unless you contact our support email address we will not contact you directly.

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
